The Indenture made the three and twentieth day of July in the twelfth year of the Reign of our Sovereign Lord King George by the grace of God over Great Britain France & Scotland Defender of the Faith - - - Between Stephen Maberly of Garsdon in the County of Wilts Tanner of the one part and John Carter of Ashton Keynes in the said County of Wilts Tanner of the other part Whereas and by our Indenture bearing date the thirtieth day of November in the seventh year of the Reign of his present Majesty King George and in the year of our Lord God one thousand seven hundred and twenty made between the Lawrence Shirley Esq of the one part and the said Stephen Maberly party to these presents of the other part he the said Lawrence Shirley for the considerations in the said Indenture mentioned did devise lease lett and to form lett unto the said Stephen Maberley All that messuage or Tenement with the appurtenances situate and being in Garsdon aforesaid in the said County of Wilts whereby the said Stephen Maberly did there inhabit and dwell and all that tanyard and tanvatts to the said messuage belonging or therewith used occupied and enjoyed. And all that close or inclosed ground with the appurtenances lying and being in Garsdon aforesaid belonging and adjoyning to the said messuage or tenement and comprising by estimate seven acres or thereabouts be the amount more or less and also in the tenure or occupation of the said Stephen Maberly his assigned or undertenants together with all houses outhouses outfield buildings barns stables orchards gardens foreyards and backsides ways waters paths passages and - whatsoever to the said messuage or tenement tanyard tanvatts? Close or inclosed ground or any of them or any part of them belonging or in any wise applying. (Except as in the said Indenture excepted) To be had and holden to the said Stephen Maberly his Executors, Administrators and Assigns from the five and twentieth day of March then next ensuing the day of the date of the said related Indenture for and during and unto the full end and term of fourscore and nineteen years from - then next ensuing and fully to be compleat and ended if Moses Maberly son of the said Stephen Maberly and Elizabeth wife of the said Moses Maberly and John Maberly son of Stephen Maberly late of Luckington in the said County of Wilts or any of them should so long live. In and under the yearly rent of ten pounds of lawfull money of Great Britain payable at the feast of St Michael the Archangel [Michaelmas Sept 29th] and the Annunciation of the blessed Virgin Mary [Lady Day, Mar 25th (first day of the year before 1752)] by equal portions and under diverse covenant and agreement in the said Indenture conteyned As in and by the said related Indenture _ being thereunto as may more fully and at large appear. Now this Indenture witnesseth that he the said Steven Maberly by and with the lycence and consent of the said Lawrence Shirley first had and obtained for and in consideration of the sum of five shillings of lawfull money of Great Britain to - - paid by the said John Carter on or before the ensealing and delivery of these presents the receipt whereof the said Stephen Maberly doth hereby acknowledge and for diverse other valuable causes and considerations him the said Stephen Maberly hereunto mooting hath granted bargained sold and assigned and set over and by these presents doth grant bargain sell assign and set over unto the said John Carter his Executors Administrators and Assigns All that the before recited messuage or tenement close and premisses and every part and parcel thereof with the appurtenances (excepting such chambers or rooms in part or prcl of the said messuage or dwelling house as the said Stephen Maberley now liveth in and the little garden belonging to the same which he the said Stephen Maberly is to hold and enjoy for his own particular use during the term of his natural life and all the estate right title interest possession for terme of years now to come and unexpired properly clayme and demand whatsoever of him the said Stephen Maberly - - - or in and to any part or prcl thereof with the appurtenances (Except before excepted) together with the said recited Indenture of lease To have and to hold the said messuage or tenement close and premisses above indicated? and any part or parcel thereof with the appurtenances (Except before excepted) unexpired determinable as aforesaid And the said Stephen Maberly for himself and his Executors and Admins doth covenant and grant to and with the said John Carter his Executors Admins and assigns that he the said Stephen Maberly hath not made done or committed or caused or procured to be made done or committed any act or matter or thing whatsoever whereby the said messuage and premisses hereby assigned or any part thereof is are or will be charged or incumbered in title charge Estate or otherwise howsoever And that the said Stephen Maberly hath not done or committed any act whatsoever or thing whatsoever to make bad the said Lease but that the same is a good and sufficient Lease in Law and was is and shall be in full force and effect unforfaited and unsurrendered And that the said John Carter his Executors Admins and Assigns shall and may from time to time and at all times during all the rest residue and remainder of the said term of ninety nine years above recited which is yet to come and unexpired peaceably and quietly enter into have hold possess and occupy and enjoy all and singular the said premises above mentioned and every part and prcl thereof with the appurtenances (except before excepted) without the let set trouble hindrance molestation interruption or denyall of him the said Stephen Maberly his Executors Admins or Assigns or any other person or persons whatsoever lawfully _ by from or under him or any or either of them and further that he the said Stephen Maberly his Executors Admins and all or every other person and persons anything - or - in the said messuage and premises above mentioned (Except for the Chamber or Room wherein the said Stephen Maberly now dwelleth and is to dwell during his life and the garden ground thereto belonging or any part thereof by from or under him shall and will at any time or times hereafter upon the reasonable request and at the costs and charges of the said John Carter his Executors Administrators or Assigns make do and execute or cause and procure to be made done or executed all and every such and further and other lawfull and reasonable -assignments or or Assurances in the Law for the further better and more perfect granting and assigning of all and singular the said premisses above mentioned _ unto the said John Carter his Executors Administrators and Assigns for and during all the rest and residue of the said term above recited which is yet to come and unexpired (determinable as aforesaid) as by the said John Carter his Executors Administrators and Assigns or his or their Counsel learned in the Law shall be reasonably devised or advised and required Insomuch whereof the said parties to these presents their hand and seals have sett the day and year first above written.
