This is the Will of me Caroline Emily Maberly of No 14 Queens Gate Gardens South Kensington Widow. I bequeath to each of my two daughters Leonora Emily and Mary Frances the furniture in use by them in their several rooms occupied by them in my said house for their own use absolutely. I also give to them my pony carriage and two sets of harness belonging for their joint and several use absolutely. I bequeath the leasehold house and premises No 14 Queens Gate Gardens together with the coachhouse and stables leased therewith and all my furniture and household effects in or about the same ( except what I may have otherwise disposed of in my life or what I may dispose of by any Codicil to my will or by any Memorandum as hereinafter mentioned ) bequeathed to me by the will of my dear husband to my executors hereinafter named upon trust as to the said house coachhouse and stables but subject to the provisions next hereinafter contained to sell the same at such times and in such manner as they may think fit and either by public auction or private contract and for that purpose to .... and do all such assurances and things as may be required. And I hereby declare that the receipt of my executors or the survivor of them or the heirs executors or administrators for the survivor for the purchase money paid shall effectually discharge the person or persons paying the same therefrom and from being bound to see to the application or being answerable for the loss or misapplication thereof. Provided always and I hereby declare that notwithstanding the said trust for sale my said executors shall permit my two daughters Leonora Emily and Mary Frances if both unmarried or if either shall be married then whichever of them shall be unmarried at the time of my death and if she or they shall so desire and of such desire shall give an intimation in writing to occupy and enjoy the said house coachhouse and stables and also the furniture and other household effects in or about the same rent free for the space of one year from the time of my death they or she paying the ground rent insurance rates taxes and other outgoings and provided further that after the space of one year from my death my said two daughters if unmarried or whichever of them shall be unmarried shall have the option to be expressed by them or her in writing to my executors one month prior to the expiration of the said year of continuing in the occupation and enjoyment of the said house and premises and furniture and effects ( subject as to the furniture and effects to any disposition thereof or of any part thereof in my lifetime or by any Codicil to my will or memorandum as hereinafter mentioned ) for so long as they or she shall elect provided they or one of them remain unmarried not exceeding nevertheless the period of eight years from the time of my death unless with the consent of my other children paying during such period half yearly as from the expiration of one year from my death such rent as shall be fixed as a fair and reasonable rent to be paid for the same by such London Houseagents in the vicinity as my executors may name for the purpose and paying all rates taxes and other outgoings except the ground rent and keeping the premises in good repair ( reasonable wear and tear excepted ) and insuring and performing the covenants in the lease. And I hereby declare that my said executors shall in the event aforesaid of my daughter or one of them electing to continue in occupation of the house stand possessed of the rent which shall be so payable to them in respect of the said premises upon similar trusts to those hereinafter declared with regard to the sale moneys of my estate and effects generally. I bequeath all the furniture books pictures other than family pictures which pass under the will of my said husband china and glass and other household goods and effects in about or belonging to the house at Mytten ( which after my death goes to my eldest son under the will of his father ) to my said eldest son absolutely. I also bequeath to him all my silver plate whatsoever except such articles as I may in my lifetime or by Codicil or memorandum give to my other children. I bequeath to my eldest daughter Henrietta Malthus the pair of silver sauceboats with initials WW on them also my emerald ring. To my son James Charles Maberly I bequeath the smaller of the two pairs of high silver candlesticks. To my daughter Leonora Emily I bequeath my halfhoop diamond ring and gold bracelets with the miniatures of her sister and my pearl halfhoop ring and to my daughter Mary Frances my diamond and emerald ring my opal ring and my mosaic bracelet. I bequeath to my goddaughter Caroline Sarah Plucknett my gold bracelet with padlock fastening. I bequeath to each grandchild of mine living at my death the sum of one hundred pounds free of duty and to my granddaughter Mary Malthus in addition to such sum my gold locket given to me by her father and mother on their wedding free of duty. I bequeath to my dear brother Edward Gillam White the sum of two hundred pounds and in the event of his predeceasing me but not otherwise I bequeath the sum of one hundred pounds part thereof to my niece Augusta Theresa Thompson the daughter of my said brother for her separate use and the remaining one hundred pounds to my nephew John Greenwood White his youngest son. I direct that my said executors shall carry out my wishes regarding the dispositions of any specific articles of furniture jewellery linen and the like whether in my house in London or elsewhere which may be expressed by me in any memorandum with my will. And as to all other my household goods and effects plate linen china books prints pictures watches jewels trinkets horses carriages and effects not specifically bequeathed or included in any such memorandum as aforesaid and including in this bequest the furniture and household effects in No 14 Queens Gate Gardens when the said house shall be sold I direct the same to be distributed and divided equally as near as may be amongst my five children. And whereas I am desirous of making up as nearly as may be to my two sons and two unmarried daughters the excess which owing to the annual sum which she receives under her marriage settlement my said daughter Henrietta Malthus will have received over and above her brother and sisters since the death of my dear husband. Now I do hereby bequeath to each of my said two sons Thomas Astley and James Charles Maberly the sum of four hundred and eighty pounds and to each of my two daughters Leonora Emily and Mary Frances Maberly the sum of three hundred pounds free of duty such sums in each case representing what I have calculated such excess fairly to amount to taking the circumstances into consideration. And as to all the rest residue and remainder of my estate and effects stocks moneys and securities and generally all my estate and effects real or personal and not heretofore otherwise disposed of and including the sale moneys of my said house when sold and also the rent thereof until sale I give and bequeath the same unto my said executors upon trust to realize and get in the same and after payment thereout of my debts funeral and testamentary expenses and the legacies hereby bequeathed upon trust to divide the same into seven equal parts or shares thereof and to pay two seventh parts thereof to my said son Thomas Astley Maberly two seventh parts thereof to my said son James Charles Maberly and one seventh part thereof to each of my said daughters Henrietta Malthus Leonora Emily and Mary Frances. Providing that if any of my said children shall have died in my lifetime leaving a child or children living at my death then such child or children shall be entitled to and I hereby bequeath to him her or them the legacy part or share or other the benefit under this my will which his her or their parent would have taken if he or she had survived. I appoint my said two sons Thomas Astley Maberly and James Charles Maberly and Richard Melvill Beachcroft of Theobalds Road Bedford Row Executors of this my will. This is a Codicil to the will of me Caroline Emily Maberly No 14 Queens Gate Gardens South Kensington Widow which bears date the twenty first day of April one thousand eight hundred and eighty one whereas I am desirous of making some further provision for my son James Charles Maberly to meet the contingency of his succeeding to the Colonelcy of his Regiment the Scots Greys Now I do hereby direct my executors to set apart the sum of one thousand pounds out of my residuary estate and to pay the same to my said son James Charles Maberly if and when he shall succeed to the Colonelcy of his Regiment and in addition to all other benefits he may take under my will and if he shall not so succeed then I direct that the said sum of one thousand pounds shall be treated as part of my residuary estate and divided amongst my children as directed my my will. And in the meantime I declare that my executors shall invest the one thousand pounds in such manner as in their absolute discretion they may think fit and shall divide the income from such investments amongst my children in the shares in which they will be entitled to my residuary estate.
